COSTA RICA TRAVEL EXPERIENCE and our services available at
www.COSTARICATRAVELEXPERIENCE.com. These Terms of Service represent a legally binding agreement between you and
COSTA RICA TRAVEL EXPERIENCE regarding your use of our website, mobile applications, networks, and related features or services (collectively referred to as the “Service”).

By clicking “I Accept,” registering for an account, downloading a COSTA RICA TRAVEL EXPERIENCE mobile app, or accessing and using the Service, you confirm that you have read, understood, and agree to be bound by these Terms, including our Privacy Policy, any applicable End User License Agreement, and additional terms or updates (collectively, the “Terms”). If you do not meet eligibility requirements or disagree with the Terms, please refrain from using the Service.
1. Eligibility
To use the Service, you must be at least 18 years old. By agreeing to the Terms, you confirm that:
- You are 18 or older.
- You have not been previously suspended or removed from the Service.
- Your use of the Service complies with all relevant laws and regulations.
If you are using the Service on behalf of an organization, you confirm that you are an authorized representative with the authority to bind the organization to these Terms. In such cases, “you” refers to the organization and its authorized users.
2. Privacy Policy, License Agreements, and Additional Terms
2.1 Privacy Policy
Review our Privacy Policy for details about how we collect, use, and share your personal information. The Privacy Policy is incorporated into these Terms.
2.2 End User License Agreement (EULA)
Your use of any downloadable application (App) provided by us is subject to the applicable EULA, which depends on the platform and features of the App. The EULA will be presented when you download or install the App and is considered part of these Terms.
2.3 Additional Terms
- Rates and services are subject to the availability of the suppliers.
- All our services must be prepaid in full prior clients’ arrival in Costa Rica
- Prepayment must be done via credit card upon payment link deliver to traveler.
- Cancelation policies apply based in each supplier cancelation rule.
- Service based in requested itinerary and service.
- Quote based in the indicated participants in the necessary occupancy
- Children will be submitted to terms and conditions from the different suppliers, hotels, tour operators, activities and more.
- If suggested hotels are not available, we will find similar hotels for travelers.
- Prices do not apply for Peak seasons such as: Eastern, Christmas, New Year, among other special dates at least are specific to that season.
- In case of no show there will not be refund.
- Travelers must sign any waver in the different activities, if require.
- Costa Rica Travel Experience will not be responsible for the luggage lost or stolen while Travelers are in Costa Rica. Please be aware of your belongings.
- Prices may change in case of taxes or government tax varies as well as seasonal changes.
- Prices are in $USD United States of America Dollars only.
Certain features or services may be governed by additional terms or rules posted periodically. These are also incorporated into these Terms.
2.4 Cancellation Policies
Cancelations policies may apply based on two main variables:

Suppliers own rules and their policies are convenient to COSTA RICA TRAVEL EXPERIENCE.
- 46 or more days, no penalty*. 100% Refund.
- 45 to 30 days 50% penalty. 50% Refund
- 29 or less days 100% of the balance. 0% refund.
*Bank fees are not refundable.
3. Modifications to the Terms
We may revise these Terms at any time. Check them regularly for updates. Continued use of the Service after changes are implemented constitutes acceptance of the updated Terms. If changes materially affect your rights or obligations, we will attempt to notify you via email, pop-up notifications, or other means. Minor updates are effective immediately, while significant changes take effect 30 days after publication or upon continued use with actual notice.
Disputes will be resolved based on the version of the Terms effective when the issue arose.
4. Accounts and Registration
To access most features of the Service, you need to register for an account and provide accurate and up-to-date information, such as your email address. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

5. User Content
5.1 General Guidelines. Some features of the Service allow users to upload and share various types of content, including but not limited to messages, reviews, photos, images, folders, and other materials (collectively, “User Content”).
5.2 License to COSTA RICA TRAVEL EXPERIENCE. By posting User Content, you grant COSTA RICA TRAVEL EXPERIENCE a global, non-exclusive, transferable, royalty-free, fully paid-up, irrevocable license to host, reproduce, modify, distribute, display, and otherwise utilize your content, in any format or platform. While you retain ownership of your User Content, this license permits us to use it as outlined.
5.3 Representations and Warranties. You are solely responsible for your User Content and any outcomes of sharing it. By posting, you confirm that:
- You own or have the rights, licenses, and permissions needed to post the content and allow its use by others, including COSTA RICA TRAVEL EXPERIENCE.
- Your content does not infringe on third-party rights (e.g., copyrights, trademarks, patents) or violate privacy, publicity, or any applicable laws. Additionally, it must not include malicious code or defamatory, offensive, or unlawful material.
5.4 Disclaimer. COSTA RICA TRAVEL EXPERIENCE is not obligated to review or monitor User Content and is not liable for its accuracy or appropriateness. By using the Service, you accept that some User Content may be offensive or inaccurate and waive any claims against us related to such content. We reserve the right to remove User Content at our discretion if it violates these Terms or any laws.
6. Digital Millennium Copyright Act (DMCA)
We adhere to the DMCA’s requirements for online service providers. If you believe content on our Service infringes your intellectual property rights, please contact our designated agent at:

Your notice must include:
- A physical or electronic signature of the copyright owner or authorized representative.
- A description of the copyrighted work allegedly infringed.

- A declaration of the notice’s accuracy under penalty of perjury.
7. Third-Party Services and Websites
The Service may integrate tools or links to third-party platforms like social media sites. By using these tools, you consent to your information being shared with those platforms. We are not responsible for the content or actions of third-party services and advise you to review their terms before engaging with them.
8. Prohibited Conduct
When using the Service, you agree not to:
- Transfer, sell, or misuse any licensed content or materials.
- Post unlawful, defamatory, offensive, or harmful User Content.
- Misrepresent yourself, impersonate others, or engage in fraudulent activities.
- Violate copyrights or intellectual property rights.
- Spam users or misuse communication tools for unsolicited messages.
- Interfere with security measures or attempt to hack the Service.
- Reverse engineer, decompile, or alter any part of the Service.
9. Termination and Service Changes
We reserve the right to suspend or terminate your account if you violate the Terms or for any other reason, including compliance with legal requirements. The Service may be modified, discontinued, or suspended at our discretion. You may also terminate your account by contacting us at
info@COSTARICATRAVELEXPERIENCE.com. However, you remain responsible for any outstanding charges incurred before termination
10. Ownership and Proprietary Rights
COSTA RICA TRAVEL EXPERIENCE owns all content, design, and code related to the Service, except for User Content. All trademarks, copyrights, and intellectual property associated with the Service belong to COSTA RICA TRAVEL EXPERIENCE or its affiliates. Unauthorized use of the Service’s materials is strictly prohibited.
11. Indemnification
You agree to defend, indemnify, and hold harmless COSTA RICA TRAVEL EXPERIENCE and its affiliates from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or infringement of third-party rights. We reserve the right to control any legal defense related to such claims.
12. Disclaimers; No Warranties
The Service is provided "as is" and "as available" without any explicit or implied guarantees. Costa Rica Travel Experience entities specifically disclaim:
(i) Any implied guarantees of merchantability, fitness for a particular purpose, quiet enjoyment, or non-infringement;
(ii) Any assurances arising from business dealings, customs, or trade practices;
(iii) Any guarantee that the Service's information or outcomes will meet your needs, or be accurate, reliable, complete, or up-to-date; and
(iv) Any guarantees about third-party products, services, or materials referenced or advertised through the Service.
You assume full responsibility for any damages, including to your devices or data, caused by using the Service. Any materials downloaded or accessed are done so at your discretion and risk.
Some jurisdictions may not allow certain exclusions, so some limitations above may not apply to you.
13. Limitation of Liability
To the fullest extent allowed by law, Costa Rica Travel Experience entities and those involved in providing the Service are not liable for incidental, special, or consequential damages, regardless of the legal theory. This includes issues arising from:
(i) Accessing or using the Service, or inability to do so; or
(ii) Purchases of third-party products or services based on the Service.
Costa Rica Travel Experience is not liable for offensive, illegal, or harmful conduct by users or third parties; you bear the risk of any resulting harm. The company is also not responsible for third-party content uploaded or downloaded via the Service.
The total liability of Costa Rica Travel Experience for claims related to the Service is limited to the greater of:
(i) The total amount paid by you for the Service in the past 12 months, or
(ii) $100.
Some jurisdictions may not allow certain liability limitations, so some restrictions above may not apply to you.
14. Dispute Resolution and Arbitration
14.1 General
You and Costa Rica Travel Experience agree to resolve disputes through binding arbitration instead of court proceedings. Arbitration is less formal, using a neutral arbitrator and offering limited discovery, but allows similar relief to a court. This applies to all claims arising under these Terms, whether during or after their termination. By agreeing to these Terms, both parties waive the right to a jury trial or class action participation.
14.2 Exceptions
This arbitration agreement does not prevent either party from:
(i) Filing an individual claim in small claims court;
(ii) Pursuing enforcement actions via applicable government agencies;
(iii) Seeking injunctive relief in court; or
(iv) Filing a court case for intellectual property disputes.
14.3 Arbitrator
Disputes will be arbitrated under the rules of the American Arbitration Association (AAA) and conducted per their guidelines, available online or by contacting them directly.
14.4 Notice and Process
To initiate arbitration, written notice describing the claim and desired relief must be sent via certified mail or email. Efforts to resolve the dispute in good faith will be made before proceeding to arbitration.
14.5 Fees
For claims under $10,000, you may choose arbitration via documents, telephonic hearing, or in-person hearing. Frivolous claims may result in fee reimbursements to Costa Rica Travel Experience per AAA rules.
14.6 No Class Actions
Claims must be made individually and not as part of a group or class action.
14.7 Modifications
You may reject future changes to this arbitration provision within 30 days of notice, maintaining the prior terms.
14.8 Enforceability
If the class action waiver is unenforceable, this section becomes void, and disputes will follow standard jurisdiction rules.
14.9 Refund Requests
Refund requests must be made within 30 days of the trip date. Investigations may take 72 business hours, and evidence may be required. Full refunds will not be issued if the service was provided.
15. Governing Law and Venue
These Terms are governed by California law. Any permissible legal action must occur in California courts. Accessing the Service from regions where its use is unlawful is prohibited.
16. General Terms
These Terms, including the Privacy Policy, constitute the full agreement between you and Costa Rica Travel Experience. Terms cannot be transferred without prior consent. Any invalid provisions will not affect the rest of the agreement.
18. Service Modifications and Cancellations
18.1 Modifications
Reservations can be adjusted through the provided self-service portal. Changes may incur price increases and are subject to service availability and cancellation policies.
18.2 Cancellations
Cancellations must be made via the self-service portal and comply with stated policies. Refunds may be issued as credit vouchers or under the Enhanced Cancellation Policy, with fees deducted. Discounts and coupons do not apply to refunds.
